Liability Waiver

Sue Yoga, LLC, is a member-managed Vermont limited liability company that does business as “Yoga with Sue.”  Susan Kirincich is the sole member of Sue Yoga, LLC.

 

In consideration of the risk of injury while practicing yoga, and as consideration for the right to practice yoga with Sue Yoga, LLC, I knowingly and voluntarily waive any and all rights, claims, or causes of action arising out of my participation in yoga. I release and forever discharge Sue Yoga, LLC, as well as its members, managers, staff, volunteers, representatives, affiliates, agents, attorneys, successors, and assigns, as well as Susan Kirincich individually, for any injury or property damage that I may suffer as a direct result of the above parties’ negligence or my own actions. I am practicing yoga voluntarily and entirely at my own risk. I understand that it is my responsibility to consult a physician regarding my ability to practice yoga safely. I am aware of and assume all risks associated with practicing yoga, both known and unknown to me, which may include physical injury, permanent disability (including paralysis), and death. Furthermore, I agree to be financially responsible for any and all legal and medical fees I may incur related to my participation in yoga.

 

I acknowledge that I have carefully read this “Waiver and Release” and fully understand that it is a release of liability. I agree to voluntarily give up any rights that I have to bring legal action against Sue Yoga, LLC, or Susan Kirincich individually for things including, but not limited to, personal injury or property damage.

 

This Agreement was entered into voluntarily and at arm's-length. Both the Participant and Sue Yoga, LLC, agree that this Agreement is clear and unambiguous as to its terms. If any terms contained in this Release of Liability are invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties.

 

I, the Participant, affirm that I am at least 18 years old. I certify that I have read this Agreement, that I fully understand its contents, and that this release cannot be modified orally. I am aware that this is a release of liability and a contract, and I am signing this Agreement of my own free will.
